Insureds
and Claimants have the right to Choose their
own repair facility!
On June
2nd, 1992, Governor Weicker signed
House bill 5793 which was passed by the
legislature on May 5th. The bill,
designed to prohibit insurers from steering
work to particular repair shops, became
effective October 1, 1992.
Substitute
House Bill No. 5793
AN ACT PROHIBITING
INSURANCE COMPANIES FROM DESIGNATING REPAIR
SHOPS FOR MOTOR VEHICLE REPAIRS.
Be it enacted by the
Senate and House of Representatives in General
Assembly convened:
Section 38a-354 of
the general statutes is repealed and the
following is substituted in lieu thereof:
No automobile
physical damage appraiser shall require
that appraisals or repairs should or
should not be made in a specified facility
or repair shop or shops.
No insurance
company doing business in this state,
or agent or adjuster for such company
shall require any insured to use a specific
person for the provision of automobile
physical damage repairs, automobile
glass replacement, glass repair service
or glass products unless otherwise agreed
to in writing by the insured
